Question: Stock Photography Licensing
This question relates to category Web Design
Answer:
iStockPhoto is a great service. They are cheap and you can find a photo of just about any subject you can think of. But clients should be aware that there are restrictions when it comes to the image licensing. Once an image is purchased, it does not give you free reign to use it wherever and however you choose.
iStockPhoto provides 'royalty free' images. What this means is that you don't pay on a 'per view' basis as you would for traditional art licences (e.g., a photo used on a billboard might garner a royalty of $100 for 100,000 views, and $200 for 200,000 views). The fact that iStockPhoto images are charged per item, and not per view makes them "royalty free".
What are the restrictions of a standard iStockPhoto licence:
- You can't use them as part of your logo or service mark
- You can't use them in a product you sell? (i.e., a mug or t-shirt)
- You can't email or redistribute them for free
- Where there is a model involved, you can't depict them as endorsing your product
- You can't use them for anything iStockPhoto deem as not appropriate (e.g., porn or violence)
- You can't transfer the images to any other party (i.e., can only be used by the purchaser)
- You can only use them for one purpose at a time (i.e., you need to purchase an image multiple times if you use them on different media - which is generally ok since they are quite cheap)
Most of these are overcome by purchasing an extended licence.
For more information about what's allowed and what's not allowed, view the iStockPhoto licensing agreement.
What does this mean to Redalto Web Design customers?
Redalto Communications sources and purchases royalty free stock photos on behalf of our clients as part of our website design service.? We do this for free to our clients, and assume any licensing responsibility and fees as part of our service to our clients. We do this to simplify the website design process and provide an end-to-end managed service.
However, should any clients wish to use these images for purposes other than their website, a new licence will need to be purchased under the name of the client or the other agency preparing the work on behalf of the client.
If you know in advance that you will be using the image for multiple medias and by multiple people, please advise us in advance as there will be licensing issues we need to investigate and accommodate for.
Often though, it's much simpler and less costly to re-purchase the image from iStockPhoto. We are happy to assist our clients with that at any time if the need arises.
